1. Agreement to Terms

By accessing or using MyNoshBook ("the Service"), operated by Cavendish Holdings ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is available at mynoshbook.com and through our mobile applications.

2. Accounts

You must create an account to use MyNoshBook. You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account and keep it up to date. You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these terms.

3. Subscription Plans and Payments

MyNoshBook offers a free tier with limited features and paid subscription plans (Basic, Cook, and Chef) with additional capabilities. Paid subscriptions are billed monthly through Stripe. Prices are displayed on our upgrade page and may change with notice.

• Subscriptions renew automatically unless cancelled before the next billing period.
• You can cancel or change your subscription at any time through your account settings or the Stripe customer portal.
• Refunds are handled on a case-by-case basis. Contact us if you believe you are entitled to a refund.
• Downgrading may result in loss of access to features available only on higher tiers.

4. Acceptable Use

You agree to use MyNoshBook only for its intended purpose: managing, organizing, and sharing recipes. You may not:

• Use the Service to store, transmit, or distribute content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated tools (bots, scrapers) to access the Service without our permission
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Resell, redistribute, or commercially exploit the Service without our written consent
• Upload malicious content, viruses, or anything designed to disrupt the Service
• Abuse the AI features by submitting content unrelated to recipes or food

5. Your Content

You retain ownership of the recipes, photos, and other content you create or upload to MyNoshBook. By using the Service, you grant us a limited license to store, display, and process your content as necessary to provide the Service (for example, generating nutritional data or creating images for your recipes).

You are responsible for ensuring you have the right to use and share any content you upload or import. If you import recipes from third-party websites or videos, you should respect the original creator's rights and use imported content for personal purposes.

6. AI-Generated Content

MyNoshBook uses artificial intelligence to extract recipes, estimate nutritional information, and generate images. AI-generated content is provided as a convenience and may contain errors or inaccuracies.

• Nutritional estimates are approximate and should not be relied upon for medical or dietary decisions. Always consult a healthcare professional for dietary advice.
• Generated images are artistic representations and may not accurately depict the final dish.
• Extracted recipes may contain errors in ingredients, quantities, or instructions. Always review imported recipes before cooking.

7. Shared Content and Social Features

When you share recipes with friends or through parties, the recipients can view the shared content. You can revoke sharing at any time. Shared recipes remain your content and the sharing features are governed by the permissions you set.

8. Account Termination

You may delete your account at any time through your account settings. Upon deletion, your personal data and recipes will be removed in accordance with our Privacy Policy.

We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or if your account has been inactive for an extended period. We will make reasonable efforts to notify you before termination, except in cases of severe or repeated violations.

9. Service Availability

We strive to keep MyNoshBook available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime.

10. Limitation of Liability

To the maximum extent permitted by law, Cavendish Holdings shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. This includes, but is not limited to, damages from reliance on AI-generated nutritional data, loss of recipes or data, or inability to access the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements. Recipe data, nutritional information, and AI-generated content are provided without guarantees of accuracy.

12. Changes to These Terms

We may modify these terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal action.
